§1 Scope and defence clause


(1) The following General Terms and Conditions in the respective version at the time of the order shall apply exclusively to the legal relationships established via this Internet shop between the operator of the shop (hereinafter referred to as the "Supplier") and its customers.


(2) Deviating general terms and conditions of the customer are rejected. These shall only become effective if they are expressly confirmed in writing by the supplier.

§2 Conclusion of contract


(1) The presentation of the goods in the Internet shop does not constitute a binding offer by the provider to conclude a purchase contract. The customer is merely invited to make an offer by placing an order.


(2) By sending the order in the Internet shop, the customer submits a binding offer directed towards the conclusion of a purchase contract for the goods contained in the shopping basket. By sending the order, the customer also recognises these terms and conditions as solely authoritative for the legal relationship with the supplier.


(3) The supplier confirms receipt of the customer's order by sending a confirmation e-mail. This order confirmation does not yet represent the acceptance of the contractual offer by the supplier. It merely serves to inform the customer that the order has been received by the supplier. The declaration of acceptance of the contractual offer is made by the delivery of the goods or an express declaration of acceptance.

§ 3 Prices


All prices are in euros. These are final prices including the statutory value-added tax. Shipping costs, if any, shall be added. Payment of the purchase price is due upon conclusion of the contract.


§ 4 Methods of payment

The consumer has the option of paying by PayPal or credit card (e.g. Visa, Mastercard, etc.).

§5 Delivery

For shipments to non-European countries, the delivery time depends on the shipping method (airmail / land / shipping) and the recipient's location.Maqu only delivers to delivery addresses (no P.O. Box) within Germany and internationally.

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery will be made within 10 working days at the latest. In the case of payment in advance, the delivery period shall commence on the day after the payment order to the bank commissioned with the transfer and, in the case of all other payment methods, on the day after conclusion of the contract. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item shall not pass to the buyer until the item is handed over to the buyer, even in the case of a sale by dispatch.

Retention of title


We retain title to the goods until the purchase price has been paid in full.

§6 Warranty

(1) The customer's warranty rights shall be governed by the general statutory provisions, unless otherwise stipulated below. The provision in § 7 of these GTC applies to the customer's claims for damages against the provider. The statutory warranty claims apply

The delivered goods remain the property of the supplier until full payment has been made.

§ 9 Disclaimer

(1) Claims for damages by the customer are excluded unless otherwise stipulated below.

(2) Excluded from the exclusion of liability stipulated in clause 1 are claims for damages due to injury to life, limb or health and claims for damages arising from the breach of essential contractual obligations. Material contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. Also excluded from the exclusion of liability is liability for damages based on an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents.

§ 10 Severability clause


Should any provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.

§11 Contractual language


Only German is available as the contractual language.

The European online dispute resolution platform ("ODR platform") is accessible via the portal "Your Europe" (http://europa.eu/youreurope/citizens/index_de.htm).
